Brandon Smith and Thomas Carey, 19, met the 15-year-old while they were playing a hockey game in Minnesota, with the girl later accompanying the team back to the Days Inn hotel after the sporting event.
Whilst at the hotel, Carey and the minor engaged in several sex acts with Smith in the room.

A few weeks later, the girl started getting messages from other hockey players and girls complimenting her on the 'nice video' she'd starred in.
The two boys then blamed one another for taking the video, adding that they definitely had the girl's consent to film her.
In Minnesota, where the incident occurred, it is not statutory rape to engage in sexual activity with a girl of 15. However, to record that encounter is 'using a minor in a sexual performance' and to store it on a device is 'possession of child pornography.'

In addition to this, sharing the recording with others is distribution of child pornography.
The defendant's lawyers are reportedly annoyed that the child porn law is being applied in this case, and they have vowed to fight the charges.
