Mum forced to hand baby over to couple is ‘gagged’ following court battle

A woman has been given a gagging order to prevent her from discussing losing custody of her baby to a gay couple.

This week a judge ruled that the 15-month-old baby should be removed from the mother, known as S, and given to her biological father, H, and his partner B.

H and B said that they donated their sperm to S after she agreed to help them have children, and that it was agreed they would be the child’s parents.

Judge Ms Justice Russell of The High Court said: “I find that S deliberately misled the applicants in order to conceive a child for herself rather than changing her mind at a later date.”

S claimed that the agreement had been that she and and H would raise the baby together, while B would have no parental involvement.

But Ms Justice Russell rejected this claim and branded the mother as ‘homophobic’, insisting it was her plan all along to ‘use the man as a sperm donor’.

She added that the baby would have a better upbringing with the two men compared to being around her mother’s negative attitude.

The mother's friend said she is 'devastated' over losing custody of her child

A friend of the mother last night told the Daily Mail: “Any accusation that she is homophobic is utter nonsense. I spoke to her after she lost the baby and she was absolutely devastated.

“When we first went to court we could not believe this was happening, and that losing her baby was an option. It is astounding. I am not going to make her out to be a saint because she isn’t always.”

Discussing the gagging order, the friend added: “The judge does not want the Press to know, she wants to gag the mother. But luckily for her she has friends like me.”
