A court heard how a man who believed his girlfriend was waking him up through oral sex after they had a row, opened his eyes to find a male stranger in his bed instead.
The man had been sleeping fully clothed in bed after rowing with his girlfriend, who was sleeping on the couch, following a night out.
When he felt his trousers being lowered, he told a Dunfermline Sheriff Court he assumed it was his girlfriend, but when he realised it was a 22-year-old man, he jumped out of bed ‘in a state of shock and anger’.
First time offender Dale Everard was jailed for 18 months on Monday after he admitted assaulting the man, while he was 'under the influence of alcohol and incapable of giving or withholding consent’.
Sentencing, Sheriff Craig McSherry told the court: ‘This was a serious offence carried out with considerable forethought. You befriended the victim’s girlfriend, went back to the flat with her, entered the bedroom and carried out the sexual assault’.
Everard, who said he was ‘ashamed and appalled by his actions' has also been put on the sex offenders register.
