Kelly Mascio from New Jersey, found the pair (who are five-years-old), in the bathroom and immediately reported the incident to the Principal, who then advised the Police and the Department of Youth and Family Services.
However in a strange decision by the Board of Education, Kelly was then suspended without pay from her position, as they seek to bring charges again her.
Over 200 people came out in support of the 'much beloved teacher' who has over 15 years of experience.
She posted a quote to her Facebook page saying: 'I call my students "my kids" because in our year together they aren't just kids on my class list, they become a part of my heart.'
Mullica Township Education Association President Barbara Rheault said that the decision to suspend Ms Mascio has caused: 'enormous emotional and professional turmoil, and has strained the confidence and trust of school staff, parents and community members.'
