Gossip Girl’s Kelly Rutherford wins custody battle: ‘We are ecstatic’

Gossip Girl star Kelly Rutherford has won a lengthy custody battle to bring her children to the US

Gossip Girl actress Kelly Rutherford- who play Lily Humphrey in the hit series- is celebrating after winning custody of her young twins.

Kelly, 46, gave birth to twins Hermes and Helena in 2009 but her custody battle started before she had even given birth.

Now a judge has ruled that the twins must return to their mother in the US.

Kelly’s lawyer said in a statement: "We are ecstatic, and hopeful that Monaco will respect the California court's ruling and send the children home. It has long been our position that Monaco has no jurisdiction because Hermes and Helena, as American citizens, have an absolute right to live in their own country.”

Kelly’s young children have been living with their father Daniel Giersch, and the actress has only been able to visit them whilst on French soil.

A US judge ruled that after Giersch’s visa had been revoked, the children would live in Monaco with him.

Kelly has led a public campaign to help courts take notice of her plight.

The actress split from her husband in 2009, filing for divorce when she was 3 months pregnant.

"I've always wanted my kids to have a relationship with him, and I've really only encouraged that all along.

“I just wanted what was right for them and their well-being moving forward. And what happened over the next six years was the most surreal, bizarre, unimaginable thing."

Kelly is now dating her Gossip Girl co-star Matthew Settle, who played her onscreen husband Rufus Humphrey.
