Devastated Kelly Rutherford loses custody of her children following six year court battle

Gossip Girl actress Kelly Rutherford shared an emotional message on Instagram after a court ruled her children are to live full time with their father in Monaco.

A Monaco judge ruled that 9-year-old Hermes and 6-year-old Helena are to live with Rutherford’s ex-husband Daniel Giersch, where Kelly will have to visit them and she will not be allowed to bring them to the United States.

The shock ruling came after the 47-year-old refused to send the children back to Monaco after they spent the summer in New York.

Defending her actions at the time, she wrote:

"I have decided that I cannot lawfully send my children away from the United States to live in a foreign country.”

But today a judge ruled the children must be returned to live full time with Giersch.

Kelly Rutherford reportedly told paparazzi she ‘had no words’ and felt ‘like any parent would feel’.

The brave mum took to Instagram yesterday to share this poignant message:

In a statement to USA TODAY she added:

"My children ask me all the time if I am still fighting for them, and I always tell them the day will never come when I say ‘no."
