New video evidence could mean that the reality star faces legal action, after the smash was caught on a mounted camera of a car passing by at the time of the incident.

The footage apparently shows the 65-year-old father’s Cadillac Escalade smash into the back of the victim’s white Lexus, and a Toyota Prius.

Due to the collision the white Lexus was pushed into oncoming traffic, and was hit by a Hummer, killing the driver instantly.

If the video does indeed show this, prosecutors may be able to argue that Jenner was following the car too closely, and could leave him open to a vehicular manslaughter charge.

But things are yet unclear, as earlier reports suggested the Lexus had already smashed into the Prius in front of it, causing Jenner to smash into the back of it.

Kim Howe, 69, was the only fatality in the pile up in Malibu, but there were several adults and children left injured.

It has been confirmed that detectives have opened a vehicular homicide investigation. If any of the drivers are found criminally negligent, they could face up to six years in prison.
