Carlos Michel, a maintenance worker, went to throw a bag of rubbish into the bin at around 8.30am when he heard what he thought was a cat mewing.
After going to investigate, he made the shock discovery that amongst the food containers, scraps and old school homework, there was a 7 pound baby in the bag too.
The child's umbilical cord was still attached.
Enlisting the help of another man, the pair took the baby to a nearby car to keep him warm, whilst they waited for police and paramedics.
The baby boy was purple and struggling to breathe when found, but is now doing well at a hospital in Houston, Texas.
Police have identified the mother of the child as a 16-year-old from nearby South Houston High School. She has also been admitted to the same hospital where her baby is being cared for.
Once she is discharged Police will decide whether to bring charges against her.
A new law has just been adopted by the state of Texas to assist new mothers who can't take care of their children.
Baby Moses law states babies up to 3 months old can be dropped off without fear of the motor being prosecuted, at any hospital, dire or ambulance station. The only condition is that the baby must be give to a person.
